One has to remember that the famous "AC21" is also a memo! My only concern is that we need to have a really good reason why we think AC21 is legal, and should be abided by, by USCIS, but the latest "E-E Relationship" memo is not legal, or is unjust...

The entire July fiasco and fix is nothing but a GRAND DISTRACTION.
Let us go back to the June bulletin. The numbers became current and leaped by many months JUST AS the Immigration Bill was being debated. This resulted in the EB folks feeling temporarily elated and quite distracted with delusion.
Then, comes the July bulletin. Making ALL numbers available made everyone ecstastic and completely distracted. This just as the debate was winding down.
Again, two key 'relief points' that magically appeared just when the legal workers' needs could have been further highlighted. Net effect, the relative pain and position was REDUCED, so it appears that the problem was being fixed and hence not that urgent.
Next, comes the EB bulletin fiasco. This completely derailed the community. The fix and elation in the past few hours has resulted in all celebrating a pyrrhic victory that will completely derail the discussion on EB issues.
Like ripples in a pond, the net effect of these events has led to a complete refocus of priorities such that even temporary fixes are being toasted and celebrated.
I am not suggesting that there is no silver lining in these clouds. The flower campaign, rallies etc have all been positive moves.
Instead of celebrating ad nauseum and thanking each other and wondering how to send thank you notes... let us FOCUS ON THE REAL PAIN POINTS and PRIORITIES ... the end goal is a predictable system and process for Green Cards.
Any interim relief, while truly and deeply appreciated, cannot be sold as the end product in order to buy our collective silence.
I request the IV Core and others to please continue to highlight the need to get EB Green Card processing professionalized and predictable, in order to ensure that the respect for the law is reciprocated in equal measure.

You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.
And what is this with so many reds besides my name..wat is this?? Ppl venting their own Frustration on others.
I read that filing EAD after I140 is already part of IV agenda. You can either donate or volunteer for it. Write to IV about it. I read that snathan had one idea and he volunteered his time to IV for it and got that done from USCIS. You can do it too. Most of us here have EAD so people who do not have EAD must take initiative.

Can we each leave a 'personalized note' on how much we have contributed in Federal / State / Social Security taxes + Medicare / etc.???? Even a rough order estimate... to get them to listen to us seriously.

2. Collect the data (anonymously, of course) and send a written brief to each Senator in that state - making a clear economic case to how we contribute
3. Collect the data (nationally, with statistical analysis thrown in) and send a written brief to all Senators - making a case at a national level.
We need eye-popping numbers, charts and quotes ... to continue the PR around high skilled immigrant needs.

Look. There are 2 sides to a coin. I was a victim by my previous employer, who is a global corporation (120 k emp), who couldn't succeed in US market.
I know many small and medium companies ( and I refuse lable them in any other way) who are good employers and who truely furthered and moved the GC applications.
This talk is not correct. The situation is due to a visa regime (regime=tight control on every aspect), neo-conservatives dictating and bulldozing policies, bums and incompetent lawmakers (some of whom get thrown out each 2 years), lack of budget and personnel (and yes, Iraq is sucking everything out) and importantly lack of organization or godfather to look after our genuine needs.
IV stepped in and is doing a yeomen service and we should be proud of it. Results will come.
All Indian owned desi companies are cheaters.

I know that with a deluge of applications, the question I am asking might not be relevent in the current scenario (July filers), but what is the historical EAD processing time? I know they say that USCIS will issue one within 90 days, but does it always take 90 days or is lot lesser?
I remember when I got EAD during OPT, it took like 30-40 days on average. Does the same hold for the EAD for EB too?

I would rather have 10,000 members paying $100/year (that's *less than $25/month, btw... :) ), than 25,000 forum browsers... no offense meant.
For those comparing IV with free web-based services like Google/Yahoo/Hotmail/others.... you probably don't grasp the idea behind IV, and this is precisely one of the reasons why a membership-based organization is desirable... :
- IV is no gmail or hotmail
- We don't get advertising revenue,
- Nor have we gone IPO like Google/Microsoft/Yahoo (neither can we... :)
- Nor are we funded by wealthy VCs
- Nor is this a "business model"

Bottomline - we're not a business, we're a non-profit organization - that needs funds for operations and lobbying efforts. There are normal operational needs that are taken care of by membership dues in most organizations. There are special one-time needs that are taken care of by funding drives.

Contrary to what most believe - Contributing is the easiest thing to do. Send some money and forget about it. And the most effective one too. Lobbying is IVs greatest tool to make changes in the legal system. If you still don't get it, you cannot get any law passed in Washington without lobbying. Whatever we do on the side is to help that effort.
Volunteering is much more tougher. By volunteering I don't mean giving the next Brightest Unworkable idea or the daily-dose of rants on an online forum. Volunteering in my world (real one) means sacrificing personal time (with family) for the greater good of a community.
Calling members, planning & conducting meetings, telecons, write letters to lawmakers and meet them, put IV booths in local events. In short, it's a thankless job. At the end of the day you're more hated than loved (ask Chandu)!
IMO Volunteering and contribution are not separate. It's member buy-in. Either you agree to a principle or you don't. If you agree, you'll contribute as well as volunteer (when you can). If you don't agree, you don't.

Atleast this new rule would help speed up that process. 45 days is certaily achievable. attorney must do a good job while asking for the documents upfront.
I dont think companies are really geared to file for 140 within 45 days of labor approval.
Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.
All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

There will be always fear that good people also will be impacted. If the person and company are geneuine then they can provide enough documentation to escape from regulation. If the person is good and company is bad then he can change the company.
I did not see any opposition from lawyers website for this except IV. Most lawyer sites advise employers to prepare proper documentation to tackle this
