You may want to visit your congressmen/congresswomen and try to help from him/her.This might take a while without doing anything. My background check has been pending since dec 2009, I have not done anything yet because my PD is not current. I will be requesting their help next month or as soon as my PD is current. IV has helped some folks who were stuck for long time. May be you can request their assistance. This is BC process could be pain ....

Yes--Universties--come under non-profit as per INS, hence exempted from quota, but not Elem/Middle/High schools.
I got my H1B from a University starting Aug. As far as I understand, there is no H1B quota for non-profit. I also have a US degree. There is a separate H1B quota for US educated.
I don't know where I was plugged in. I don't remember any details.

I would say the activity in state chapter participation is '5%' at best in contributing members. By that token, you can ignore the non-contributing members. I see thousands of messages in retrogression and like forums while I see hardly dozens of messages in state chapters forums.
Take the example of state Texas, it has one of the largest pool of House Reps in congress and folks impacted by retrogression in this state is very high. Most of these House Reps are anti-immigrant. I am not sure if it is for both legal and illegal. In TX, there is no state chapter activity for the last 4 months. I called for a meeting, not one responded. I think IV core should come up with a specific schedule for each of the state chapter meetings and also core team should assign a contact for each of the state chapters. Core team should also participate in these meetings to provide a directed leadership. If need be, induct more members into core team..

Nothing was mentioned about H4's ability to work before because it has never been asked before as an agenda item for Immigration Voice. Yes, the inability of H4 visa holders to legally work has been discussed several times on this forum but no one has asked for it to become an agenda item or a goal for this organization before. Today it happened, and so I clarified that H4 related issues, the issues that affect only H4 are not a part of this organization. There are many agenda items that improve the situation of H4 spouses. Indirectly thru most of Immigration Voice goals, H4 spouses get benefit. And that is plenty of reason for H4 spouses to support Immigration Voice.
However, none of IV's goals have an item dedicated to H4 that benefit H4 only.
Goals of Immigration voice are listed on the homepage. Under item called "Immigration Voice Goals".
Ability to file for final stage of the Green Card even without visa number availability – this will provide tremendous relief during the long wait since it will allow applicants to transfer to jobs with an identical job description, travel freely, and allow their spouses to contribute to the economy.

Though your case is weak(in my personal opinion because you seem to have entered US uninvited), A complaint against the employer may unravel some strong cases when the investigation happens.
This is from my experience:
Few years ago, some one complained against our employer about back wages and we all benefited from it. Our employer had to pay the wages for the vacations that we took (supposedly paid vacation) which they would not have paid, if the investigation had not occurred.
Though your case is weak(in my personal opinion because you seem to have entered US uninvited), A complaint against the employer may unravel some strong cases when the investigation happens.

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?
Nothing to panic, browse through chanduv23's posting(s) - you will be back in track in few weeks.

That is the way the USCIS is interpreting the laws and actually doing it that way...There are two different caps applied to you....The EB2 cap of wharever numbers available and the country cap of 7% for all of china EB+FB combined together.......It is true that there are more EB2 numbers available...But as the country quota for CHINA/India is over they are flowing to EB3 ROW instead of flowing horizontally to EB2 china....There is a big discussion about how this flow occurs and if it is fair or not...The title of that thread is 'Unused visas' Reading that would be helpful to you...

I suggest, lets have a request to Bollywood artist to organize some shows at USA in benefit of IV (they may give us some discount). We shall pay back 63K to Aman (IV can keep 1k as his contribution).
Other option is 630 people should contribute $100 each to pay back Aman. I received my green card and ready to contribute $100 to this account. I already contributed $700.

According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
Never mind the spillover, can ROW just get its normal quota at least?
