My attorney received the RFE yesterday (just under a week after the email notification) (and I haven't received anything directly yet).
They wanted copies of the original I-485 and G325A forms (for both my wife and me), filed in Aug. '07, signed again.
Nothing changed or updated, just our signatures above the "signatures" the attorney/representative put in the original forms for us, in 2007.
Hopefully this is all they want and not more once they receive this...fingers crossed, not holding breath! :)

As IV is willing to help those having issues with employers by providing a platform and interfacing with DOS, USCIS, DOL, Media, lawyers and support in any form - nothing stops people from standing up for themselves and report an abusive employer.

However, though we talk so much, people are still scared to identify themselves against the employer. However, they may be ready to outline everything against the specific employer as an anonymous person. we got to deal with a situation where people are ready but anonymously. How can we handle this.

Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.

Since this discussion has been going on for 5 pages, i thought ill add my 2c.
Firstoff i haven't gone through all 5 pages so if someone already mentioned this, please don't jump on me. You can create an SBI account called SWIFT account. They will give you an account number and a SWIFT code for the bank.
You can then initiate a wire transfer from any bank in the US. They charge a flat rate of around 35-45$. The good part is, you can have the money sent in $ to your local account. They say it takes 3 days but it never takes more than one day for me.
The money is saved in FD as dollars and earns you interest if you leave it for 11 months. If you need to convert it any time, you have to forgo the interest (as with any FD) and you can get the closing exchange rate of the previous day.
This has many advantages
1) one simple fee of 35$
2) In case you want to bring back the money to the us, since it is kept as dollars, you can transfer it back without any hassle. (To keep it in dollars , you may have to provide this as a special instruction)
3) Folks back home have control on exchange rate, they can cash it any time it is high
4) Takes less than a day in most cases.
If you do the math, you will see that this is better than icici when you are sending 4000$ or more approx. icici does not take fees upfront but they always give you almost 50p less than exchange rate.
I have used this 4 times so far and its very reliable.

They either have to reject the application or provide the receipt notice. Cannot hold the applications without any actions for long time.

I have the same frustrations:
1. Waiting for labor for almost 4 years.
2. Haven't made to 140.
3. Wife on H4, very frustrating for her.
4. Potential contracts/jobs missed.
5. Tired of waiting. Another year???

I am tired but I would like to do something while I am waiting... that's why I am thinking of starting PMP. That way, if I eventually get GC or end up moving to some other country I will have some value addition.

1. I am pursuing an MBA from Berkeley and aspire to start a technology based firm to create products that iron out inefficiencies in various processes. However lack of permanent residency is holding me back.
2. I have almost single handedly built a product that uses complicated mathematical models that saves US corporations millions of dollars in shipping costs. The directly competing product is built by a group of professors and PhDs. I want to use my current experience along with my managerial education to positively contribute to the society.
3. My wife and I plan on buying a house but again lack of permanent residency is holding us back.
In short, I would have contributed more to the society and have grown faster professionally if I had the security of a permanent residency.
Just because I happen to be from a country with a large population, I get hit by the green card quota and have to patiently wait for about 10 years when someone from a different country with similar qualifications gets the residency in about a year. Is this fair?

A member-driven and membership-driven organization will not have to taunt members into contributing or shaming them to contributing, imho.
If we become verified and paying members, personal email messages can be sent out for the (less frrequent, perhaps) funding drives. A code of etiquette or something akin to it should be enforced that spells out the rules of participation in forums as well, and discourage such comments.
You pay the basic membership - you get on board. When extra funding is required, you do what you can - there's no extra pressure or shaming anyone into contributing.
There can be *plenty of other benefits*, and an organization sufficiently large enough can probably generate enough revenue to have at least 1 full time person on board coordinating stuff... or a bunch of volunteers and part-timers (for folks who have their EADs and are using it, this would be a chance to jump in... and help out).

If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.

Yes, I guess the slowdown will happen when it hits the 2005 mark when PERM was introducted and a lot of EB3 were converted into EB2
I believe overall, in 2005 few LCs got certified compared to the previous years..so i am guessing the real slowdown will start from Dec 2005...

I, for one, am unable to join a state chapter, because , the nearest chapter is 400 miles and 2 states away. What good would it do to me to join something that I can never be part of. I wanted to start a state chapter here in my place, but I couldnt find any useful resources on how to do it. May be eb3_nepa has some reasons like it.
I was also unable to find a state chapter just a few months back. So I started one. Now we have around 60 members. Someone needs to take the initiative and set the ball rolling. That someone can be you.

The Admin Fixes letter campaign was a good initiative. But, the target date got moved twice, and now I dont even know when the end date is.
The end date is the date when the fixes get passed.
IV moved the target dates to get more letters from members. It paid back richly as thousands more letters were got through the hardwork of volunteers who collected these letters. As pointed by paskal work is in progress on the campaign and more stuff is getting done.
May be IV should be a top-down organization. Any organization as big as IV would probably be better served with a Top Team. That team could probably elected by the community. I am confident, that most of our members wouldnt even mind spending a few extra bucks to pay a honarary amount to this team for their efforts and time. Then there will be more structure and accountability and action going on around here.
If you really think you can get someone like Aman Kapoor - who visited DC 18 times last year spending 60k of his personal money - by paying a few extra bucks, be my guest!
IV is a volunteer organization. Its strength is volunteers who believe in the cause and ready to spend their efforts and money for a cause that benefits not only them, but also the slackers who do nothing and sit on the forum badmouthing/belittling those who do.
A paid person will not do all that for you for the few extra bucks you are ready to pay.
I came to know about IV pretty late. When I did learn about IV and joined IV, I was a very enthusiastic participant. Of late, I do believe IV is fading away. I dont see so many activities going on around here. Like eb3_nepa and few others said, IV is right now becoming just another Immigration portal. It is starting to lose its identity.
After doing all the hard work to gather a mass or like minded people, it will be shameful, if IV drifts away from its stated aim. So, may be it is time for every member, including core members like you to refect upon things and come up with ways to make this organization more transparent and more accessible for people like me.
Don't judge IV by what's posted on the forum. IV is more than a forum. A lot of action happens off the forum (in fact most of it). Like Morpheus told Neo in Matrix, 'No one can tell you what it is. You need to experience it yourself'. Participating actively in IV activities through state chapters is the only way to know all IV activities happening.
It will never get posted here in a forum full of anti-immigrant trolls. IV is transparent in its finances as it gets audited as a tax-exempt organization and held accountable to its expenses. Transparency is bi-directional. IV expects its members seeking updates to be transparent too (by providing complete contact details and valid E-mail ids). When a large number of members aren't transparent themselves, asking IV to be transparent is a moot point.
Like Waldenpond said, it is probably not wise to list all the items going on in the portal. The work around to that would be, we can add another membership type which is more restrictive. This membership group will have only members whose identities have been verified. Once this group is created, IV can post all the happenings accessible to them. This will help people like me who are unable to be part of any state chapter to know what is happening at IV. Keep our sprits high.

An alternative bill that already passed the House of Representatives would turn the country�s 11 million undocumented immigrants into criminals, subject to arrest by local authorities. �If you are an undocumented immigrant in the United States, at the moment you have two choices: You can either stay put and hide, or you can lose everything you have,� said Kelly Fincham, executive directors of the newly formed Irish Lobby for Immigration Reform, which organized the meeting at St. Mary�s Help of Christians Catholic Church. Fincham urged those in attendance, even ones who cannot vote, to call or e-mail their U.S. senators and representatives and ask them to vote for the Kennedy-McCain bill. �Do you really want your future to be decided behind closed doors in Washington, or do you want to have a voice?� she asked. An early indicator of the success of her group, formed in December, was the attendance of U.S. Sen. Charles Schumer, who received a standing ovation after addressing the Friday meeting. �If we were to cut off immigration in this country within two, three or four generations, we would become a tired, stagnant, stratified society,� he said. New York �is a special place because of immigration and the worst we could do is close the door,� he added. Other speakers at the meeting urged audience members to sign up and bring their friends to a March 8 bus trip to lobby Congress in Washington, D.C. Groups from cities such as Boston will also be bused in. �This is about living a normal life without fear so you can go and enjoy life in the greatest country on earth,� said Naill O�Doud, chairman of the Irish Lobby for Immigration Reform. Congress is expected to pass sweeping immigration reform legislation later this year affecting America�s estimated 11 million undocumented immigrants, of whom around 40,000 are Irish. One version, which already passed the House of Representatives, is an �enforcement only� bill sponsored by Representatives James Sensenbrenner (R-Wis.) and Peter King (R-N.Y.). Known as the Border Protection, Antiterrorism, and Illegal Immigration Control Act, the measure makes it harder for legal permanent residents to become U.S. citizens by allowing government officials to deny naturalization applications based on subjective information or secret evidence. The measure intensifies sanctions against employers who hire undocumented immigrants and requires them to confirm the authenticity of their workers� Social Security numbers. It gives local police the power to enforce immigration laws and penalizes states and cities that protect confidentiality of immigrant crime victims and witnesses. Other provisions would make drunken driving a deportable offense and mandate the construction of five double-layer border fences at a cost of $3.2 million per mile. The Kennedy-McCain bill, known as the Secure America and Orderly Immigration Act, was introduced before the Senate last year by Senators Edward Kennedy (D-Mass.) and John McCain (R-Ariz.). The measure would permit undocumented or �illegal� immigrants currently living in America to obtain work visas for up to six years. They could apply for permanent residency after paying fines, passing a background check and completing a period under a temporary visa. The bill would also create a new path to legal immigration through a temporary worker program. Undocumented Irish immigrants present at the meeting said current laws prevent them from returning home to visit family. They pay taxes, but cannot apply for health insurance or open bank accounts, much less obtain a driver�s license. One had a nursing degree from a local university but could not work as a nurse because she had overstayed her visa. Another told similar stories of friends who had advanced degrees but could only find work as laborers. �You�re nervous all the time. You�re always looking over your shoulder,� he said.

On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues
Description for denial ( I have also attached the denial notice)->
They looked at years 2003 to 2006 history for I140 since PD is JAN 03.
* Reason 1 - Lower salary than specified in labor
Preferred Wage in labor - 78,750
W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.
* Reason 2 - negative net income of the petitioner
2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);
* Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
and my lawyer did not provide 2006 information

Your application was denied not with a combination of
Reason 1 , 2 & 3, but each reason by itself was insufficient to prove ability to pay. Your employer should meet atleast one of these to prove "Ability to Pay".
It's deplorable that most attorney's don't educate small employers on meeting ability to pay even before filing the Labor Certification.
I would suggest that you appeal the case with supporting statements from a good CPA and in the meantime go for a fresh labor certification.

I agree. Atleast word "Legal" was spoken. I am confident Democrats are well aware and once they come in power they are gonna clear all mess. These all artificial backlogs could not have been created until asked for by some one with political clout. USCIS is just a puppet. Our cause of problem lies somewhere else.
I hope Republicans don't come to power again.
We have to keep doing this... Senetor Obama mentioned 1 line about fixing Legal Immigration process, also both Senators mentioned that ILegal Immigrants will be last in the line of the process so that is a huge progress for us... These candidates have an army of people working for them, they do a lot of research go to forums, go to debate websites to see what are the pain-points, if we can get our questions in top 10 in every debate now on then Legal immigration will be in the spot light, that is half the battle won... regardless who is chosen by voters they will all have legal immigration on their agenda. Good job guys! Keep posting the questions we will make this issue popular!
